Becoming an American Citizen - Your Permanent Legal Right to Live in the USA
If you were born outside of the United States and wish to immigrate and live here, you can apply to become a US citizen.
Your benefits from acquiring US citizenship are invaluable. You can apply for a US passport, and participate in the economic and business opportunities available to all US citizens. You will be granted voting rights, and as a legal US citizen you can hold public office. US Citizens have standing to petition for immigration visas for their close family members, including their spouse, parents, and children, who can join you and live with you here in the United States.
Paths to Citizenship
Legal permanent residency is the first step required for citizenship. There are many different categories for eligibility to obtain legal permanent residency, and our unbundled attorneys can assist you in determining the best choices and options based on your own personal circumstances.

The official document granting legal permanent residency to foreign born immigrants is called the "green card." When a green card is issued, the holder acquires rights to permanent residency in the United States. In addition, a green card holder can travel and return to the United States, obtain employment, and petition the US Citizenship and Immigration Service (USCIS) to have close family members obtain their own green cards.
Although holders of green cards can travel outside of the country, they have limitations on how long they can remain away, without suffering a declaration of abandonment of their US residency. Green card holders do not yet have voting rights. There are also restrictions on eligibility for certain government benefits. For example, there is a five-year waiting period to receive Supplementary Security Income (SSI), or Medicaid. Contact an unbundled attorney to help protect the benefits and other important rights you may be entitled to when applying for US citizenship.
Eligibility for Citizenship
US laws permit several categories of persons who were not born in the US to become legal US residents and citizens. Green Card holders who have been continuous US residents for at least five years and can speak and write English are eligible to become US citizens. Our unbundled immigration attorneys can help confirm that you meet all the requirements for your citizenship application.
For instance, the USCIS (United States Citizenship and Immigration Services) requires that each applicant must reside in the nearest USCIS district for 90 days prior to their application. Applicants must also have had a physical presence on US soil for a minimum of 30 months during their most recent 5 years of US residency. After a formal application is submitted, an applicant must then continuously reside in the US until legal citizenship is awarded. Finally, applicants must demonstrate they are of good moral character.
Alternative Paths to Citizenship
If you are an immigrant residing either outside or within the United States, you may qualify for a green card through a US employer who is willing to sponsor you for a permanent job.
There are four distinct categories of employment that qualify for employer-sponsorship: EB-1, EB-2, EB-3, and EB-4. You can discuss which category you qualify for with an unbundled immigration attorney provider.
The USCIS has special green card categories for immigrants who are entrepreneurs and investors, and can create jobs in the US. A entrepreneur-immigrant, whether living abroad or in the US can be joined by a spouse and children who are under age 21 in their application for a green card. There are several requirements to meet this entrepreneur qualification, so talk to an unbundled attorney for details.
There are other categories that an immigrant to the US can consider in order to obtain a green card. A self-petitioner who has special talents or qualifications may apply. Similarly, those granted refugee status or political asylum, may apply for a green card and permanent residency.
